The U.S. Citizenship and Immigration Services (USCIS) published new criteria and guidance regarding O-1 visa occupations in January 2025. This new update broadens the scope of the O-1 visa eligibility question and makes the application process more flexible and straightforward, particularly for those working in emerging fields. Here are the occupational groups that have been further clarified in this update:
- Critical and Emerging Technology Experts: Experts who work in fields such as artificial intelligence, biotechnology, nanotechnology, and who present important projects to these sectors.

- Flexibility in Job Changes: It provided flexibility in job changes, which are common in the technology field, and stated that applicants can continue to use their existing visas when they receive new job offers.
- Recognition in the Field of Expertise: Applicants must submit documentation demonstrating their prominence and recognition in their field. This documentation may include national or international awards, industry achievements, media coverage, or other evidence of professional achievement in their field.

The US O1 visa application process, with updates for January 2025, is generally as follows:
- Application through a Sponsor or Employer: The applicant's company may apply as a legal entity on its own behalf.
- Preparing Required Documents: Gathering awards, certificates, publications, and other documents that attest to the applicant's exceptional abilities.
- Contract or Agreement: An employment agreement between the candidate and the sponsoring employer.
